Terms of Service

Welcome to Carestify.ca (“Carestify”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, tools, and any related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Informational services only

Carestify provides educational and informational content related to used vehicle valuation, market context, and maintenance considerations. Outputs are estimates and narratives—not guarantees, appraisals, offers to purchase, or professional financial, legal, insurance, or tax advice. You are solely responsible for decisions you make after using the Services.

2. Eligibility and acceptable use

You may use the Services only in compliance with applicable laws, including Canadian federal and provincial privacy and consumer protection laws where they apply. You agree not to misuse the Services, including attempting to probe, scan, or test the vulnerability of any system, interfere with access, scrape at a rate that harms performance, or submit unlawful, fraudulent, or harmful content.

3. Accounts, submissions, and user content

If you submit forms, survey responses, vehicle details, or other materials (“User Content”), you represent that you have the right to provide that information. You grant Carestify a non-exclusive, worldwide, royalty-free license to use User Content solely to operate, improve, secure, and analyze the Services (for example, to generate a report, prevent abuse, and improve product quality).

4. Third-party services

The Services may integrate with third-party infrastructure (for example, hosting, analytics, AI providers, advertising partners). Third-party services are governed by their own terms and policies. Carestify is not responsible for third-party services we do not control.

5. Advertising

Carestify may display advertisements. Advertising partners may use cookies or similar technologies as described in our Privacy Policy. Unless expressly stated, advertisers are not endorsers of Carestify content and Carestify does not endorse advertised products or services.

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARESTIFY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARESTIFY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. IN NO EVENT SHALL CARESTIFY’S AGGREGATE LIABILITY FOR ANY CLAIM EXCEED THE GREATER OF (A) CAD $100 OR (B) THE AMOUNTS YOU PAID TO CARESTIFY FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Indemnity

You will defend, indemnify, and hold harmless Carestify from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Services, or your violation of these Terms.

9. Changes

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws applicable in your province of residence and the federal laws of Canada, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your province of residence provide otherwise.
